Have you imagined your copyright is being infringed in Japan?
Through our research, we found a possibility that a quite large amount of oversaes writings have been illegally used in English textbooks issued by many Japanese cram schools.
In order to unveil and eliminate a copyright infringement, we would like you to help us to make sure whether appropriate permission had given to those textbooks. JVCA can be your window in Japan, and we are willing to consult you for more detailed information to ask for compensation and to recover your copyright.
■ Background
While we substitutionally issue permission for secondary use of our membership authors'(Members) works, we are monitoring copyright infringement regardless our membership.
Members also have translated readings, and in the case, we need to consult with overseas authors prior to the permission. Through communication and our monitoring activities for overseas materials, we have found a possibility that most English writings have been used in English textbooks isssued by cram schools without permission.
Let us make counter argument to "fair-use" for educational purposes. We have questioned this because cram schools are not "school" but just private companies which are pursuing profit. Indeed, thanks to expensive fee, their business is so profitable that they can build branches building in any prime locations. Please do not forget the fact that cram schools are private companies, and their field is secondary education. There are no difference with other field such as cars, electronic appliances, foods, and etc.
Now, do you still think this is "fair-use"?
While they yield so much profit, they are using overseas writings without paying a usage fee because of the "fair-use" argument, which became just an excuse for exploitation.
Previously, even Japanese writings have been exploited by the same reason. However, JVCA has been largely contributed to decrease those illegal usage thanks to cooperation by our members and the law. Nowadays, though we still occasionally find copyright infringements through our monitoring, we could prove that their "fair-use" argument is unfair.
■ Our Achievement
We are confident that we achieved to inculcate the idea of copyright in Japanese readings.
However, please remember that even copyright of Japanese writings in Japan were ignored - naturally imaginable for overseas ones. This is surely mass illegal copying, and we now decided to expand the research. For the culture, the business or yourself, copyright infringement cannot be left alone.
To stop further copyright infringement, please help us to make sure whether you gave a permission to use for such textbooks.
